Kyle and Jackie O update: ‘Could be strategically smart’: Lawyer weighs in on whether we’ll see Jackie O head to court in coming days amid her legal battle with ARN


Radio star Jackie ‘O’ Henderson has a whopping $82.25 million lawsuit against ARN, while her former co-host Kyle Sandilands has his own legal battle and $85 million lawsuit against their former employer for wrongful termination, after their Kyle and Jackie O Show was yanked off the air.

The pair’s respective hearings are set to be heard before a judge in Sydney on Friday in the Federal Court.

Sandilands, 54, fronted the Federal Court for his case on March 27 and was greeted by a media scrum, with all eyes now on Henderson, 51, to see if she shows up and does the same this week.

Lawyer Nick Duggal, from Moray & Agnew lawyers, who has expertise across workplace and education law, tells to nine.com.au it will be interesting to see if Henderson appears in person.

“Whether Jackie O attends on Friday will be illuminating,” Duggal says.

“Jackie O has kept her powder dry in this dispute while ARN and Kyle made critical early moves. This could be strategically smart.

“Will she continue to be a X factor in this three way dispute and keep the other parties guessing? Or will she lean into the media spectacle by attending on Friday and begin telegraphing her punches?”

Duggal says we’ll have to wait and see.

“The case management hearing is an early opportunity for Jackie O’s counsel to give a succinct summary of the crux of her case. This can be useful in planting to seeds in the mind of who is anticipated to be the trial Judge,” he explains.

“ARN’s and Kyle’s lawyers may also have a further, early opportunity to summarise the central narratives of their cases.”

Amid speculation Sandilands and ARN might reach a settlement with their battle, Duggal adds: ”There is media reporting that Kyle’s team is negotiating his return to the airwaves with ARN.”

“Judges tend to want to be updated on settlement discussions at case management conferences. Look for the Judge to ask for an update on settlement discussions, and also whether he and/or the parties want to book in an early mediation”.

It comes after a complaint letter Henderson sent ARN from her lawyers with allegations against Sandilands was revealed in court documents seen by nine.com.au this week.

It was made public as part of ARN’s Defence documents and sent on February 26, days after their on-air clash on February 20 that spurred the end of their top-rating show.

In it, she alleged she was left “psychologically unwell, defamed and humiliated” from “consistent bullying” by Sandilands.

“The mere fact that this behaviour is frequent and has been continuing for a prolonged period of time also goes to demonstrate that the Group has not taken the required action to act in compliance with its obligations to provide a safe place of work,” the letter alleged in part.

“There is evidence that she has endured persistent and relentless bullying by Mr Sandilands well before the 20 February 2026 incident which despite numerous opportunities, the Group has failed to adequately address both at law and ethically.”

“Should a report be made to SafeWork NSW, it is now highly likely that the group will be found to have breached its duty of care to Ms Henderson by exposing her to Mr Sandilands’ bullying conduct over a prolonged period,” the letter continued.

They also allegedly had a spat in September 2025, where Sandilands allegedly told Henderson: “Don’t f—ing bother coming back either until you get your f—ing s–t together like a normal person.”

“I’ve been carrying this show for a f—ing year… I’m just left here with a limp d–k in my hand.”

Nine.com.au is not suggesting the allegations are true, just that they were filed in the defence documents.

Sandilands was stood down following an on-air clash with Henderson on February 20, after she read from Andrew Mountbatten-Windsor’s astrology birth chart.

He has consistently denied breaching the terms of his contract.

Sandilands previously released a statement, announcing his termination from ARN. 

”Ms Jacqueline Henderson has given notice that she ‘cannot continue to work with Mr Kyle Sandilands’,” ARN said in a statement previously about Henderson.

“Accordingly, ARN has terminated the services agreement with Henderson Media Pty Ltd, under which Ms Henderson presents the Kyle and Jackie O show.

“Ms Henderson will cease to present the Kyle and Jackie O show.

“ARN has also offered to Ms Henderson the possibility of an alternative show on the ARN network,” it added in part.

Henderson, 51, broke her silence in a statement claiming she “did not quit or resign” from The Kyle and Jackie O Show after the program was pulled from the KIIS FM airwaves by ARN.

“Over the past few days, there has been a lot of speculation and misinformation about my departure from the show.

“I want to make one important point very clear: I did not quit or resign.”
